Introduction
Intellectual Property (IP) law protects intangible, intangible, and mental creations—such as inventions, literary works, designs, symbols, and brand names—by granting creators exclusive rights to control and commercialize their work. Key pillars include copyrights, patents, trademarks, and trade secrets, aimed at fostering innovation, securing moral/economic rights, and preventing unauthorized use.
Intellectual Property Law covers the fundamental concepts and legal frameworks surrounding patents, copyrights, trademarks, and trade secrets, as well as related areas like passing off and confidential information. It explores the requirements for protection, the scope of rights, infringement, and remedies, along with relevant international treaties and agreements.
Course Contents
· Introduction to Intellectual Property: This includes an overview of different types of IP, the rationale behind IP protection, and the role of IP in society and the economy.
· Patents: This section covers patentable subject matter, requirements for grant (novelty, non-obviousness, and utility), patent exploitation (licensing and assignment), and infringement.
· Copyright: This module examines copyrightable subject matter, copyright ownership, rights of reproduction, distribution, and performance, as well as infringement and fair use.
· Trademarks: This includes trademark types, distinctiveness, registration procedures, infringement, and the concept of dilution.
· Trade Secrets: This area focuses on the protection of confidential business information, including requirements for trade secret protection and remedies for misappropriation.
· Designs: This section covers the protection of the ornamental or aesthetic aspects of products.
· Other related areas: Passing off, misleading and deceptive conduct, and confidential information are also often covered.
· International and Comparative Aspects: The course may also touch upon international treaties and conventions related to intellectual property (like TRIPS) and comparative analysis of different national IP
systems.
· Emerging Issues: Some courses may also address emerging issues like the impact of new technologies (e.g., AI) on IP law and the protection of indigenous cultural and intellectual property.
